[ARCHIVED] If you go over a pothole on a NYS road and damage your car NYS is not responsible

PRESS CONFERENCE TOMORROW

Assemblymember Tom Abinanti -who represents Greenburgh in the Assembly,  invited me to a press conference tomorrow  Sunday) to bring attention to potentially dangerous and costly potholes that they say the State should be liable to fix when drivers get a flat. Currently, legislation (A.1235/S.5422) sponsored by Abinanti is on the Governor’s desk that would make the State liable for pothole damages on State roads year round as opposed to just May 15th through November 15th.  Did you know that if your car is damaged on a state road after November 15th to May 15th that the state doesn't have to reimburse you for damages?

NYS promised to repave Saw Mill River Road in Ardsley and Hillside Ave in Greenburgh this year but has advised us that the work will be postponed till April of next year due to the poor weather conditions. That  means if you go over a pothole -ruin your car- you won't get a penny from NYS.  Road conditions are Dobbs Ferry Road, Knollwood Road, Central Ave, Saw Mill River Road in Elmsford are also in bad shape.

If you have experienced car damage because you went over a pothole on a NYS road --and if you never got reimbursed and are mad, feel free to join us at the press conference tomorrow.  If it rains -we'll try to find a location that has shelter.  We hope that the Governor will sign the Abinanti legislation.

PAUL FEINER
